En matière d'assainissement non collectif, les obligations respectives des communes et des particuliers sont les suivantes.

Les communes
La loi sur l'eau du 3 janvier 1992 a instauré la création d'un service public de l'assainissement non collectif dans toutes les communes.
Le rôle de ce service est d'assurer le contrôle des dispositifs individuels par une vérification des installations ayant moins de huit ans, ou par l'établissement d'un diagnostic pour celles qui ont plus de huit ans ; des travaux peuvent être prescrits à  cette occasion.

Les particuliers
Ils doivent faire assurer régulièrement l'entretien et la vidange de leur dispositif individuel par une personne agréée.
Ils doivent éventuellement faire procéder aux travaux prescrits par le service public de l'assainissement non collectif, dans un délai maximum de quatre ans.

Mise en oeuvre des dispositifs légaux
La mise en oeuvre du contrôle par les services publics de l'assainissement non collectif devra être généralisée au 31 décembre 2012.
D'ici là, l'obligation d'entretien et de vidange demeure pour les propriétaires, dont la responsabilité serait engagée en cas de pollution.
Il est donc recommandé pour toute question relative au zonage, aux types d'équipements autorisés, et à  la date d'entrée en vigueur du contrôle exercé par le service public de l'assainissement, de prendre contact avec sa commune.
